Welcome to Smart Restore. By accessing our website or engaging our services (including Emergency Make-Safe, Water & Fire Restoration, Mould Remediation, Roof Restoration, and Home Maintenance), you agree to comply with and be bound by the following terms and conditions.

1. Engagement of Services

By requesting a service or “Make-Safe” call-out, you enter into an agreement with Smart Restore. Our services are provided based on the descriptions outlined in our quotes, work orders, or emergency service agreements.

2. Emergency & Make-Safe Services

Response Times: While we strive for rapid 24/7 response, arrival times are estimates and may be affected by weather, traffic, or existing demand.
Nature of Work: “Make-Safe” services are temporary measures designed to prevent further damage or safety hazards. They do not constitute permanent repairs unless explicitly stated in a separate scope of work.

3. Quotes, Pricing, and Variations

  • All quotes are valid for 30 days unless otherwise specified.
  • Prices are inclusive of GST unless stated otherwise.
  • Variations: If, during the restoration process, additional damage is discovered that was not visible during the initial inspection, Smart Restore will provide a variation quote. Work will proceed once the variation is approved by you or your insurer.

4. Payment Terms

Direct Residential/Commercial Clients: Payment terms are outlined on your invoice. We may require a deposit before commencing large-scale restoration works.
Insurance Claims: If your work is covered by insurance, you authorise Smart Restore to communicate directly with your insurer. However, the property owner remains ultimately responsible for payment if the insurer denies the claim or fails to settle the account.
Late Payments: We reserve the right to charge interest on any overdue accounts in accordance with Australian commercial law.

5. Site Access and Safety

To perform our services effectively, you agree to:

  • Provide clear and safe access to the property at the agreed times.
  • Ensure the work area is free from pets, unrestrained children, and hazardous personal items.
  • Notify our technicians of any known hazards (e.g., asbestos, electrical faults, or structural weaknesses) prior to commencement.

6. Insurance Coordination

Smart Restore often works alongside insurance providers. While we assist with documentation, reports, and digital imaging for your claim, the contract for insurance is between you and your insurer. We do not guarantee that your insurer will cover all costs; please consult your policy PDS (Product Disclosure Statement).

7. Limitation of Liability

To the extent permitted by the Australian Consumer Law:

  • Smart Restore is not liable for any pre-existing structural defects or damage not caused by our technicians.
  • We are not liable for any indirect or consequential loss resulting from a disaster event (e.g., loss of rent or business interruption) while restoration is underway.
  • Our liability is limited to the re-performance of the services or the cost of having the services supplied again.

8. Cancellations

  • Cancellations for scheduled (non-emergency) works must be made at least 24 hours in advance.
  • Late cancellations or “no-shows” may incur a call-out fee to cover travel and scheduling costs.

9. Warranties and Guarantees

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures, you are entitled to a refund or compensation for the drop in value. We provide workmanship warranties on permanent repairs as specified in your final project contract.

10. Mould Remediation Disclaimer

Mould is a biological product of moisture. While Smart Restore follows IICRC standards to remediate mould, we cannot guarantee that mould will not return if the underlying moisture source (e.g., a structural leak or lack of ventilation) is not permanently rectified by the property owner.

11. Governing Law

These Terms and Conditions are governed by the laws of the State or Territory in which the service is performed within Australia.
